Court has collected $4.5 mln from Mechel on the claim of Sberbank Leasing

​The Arbitration Court of Moscow has satisfied the claim of Sberbank Leasing and collected the debt by the lease agreements at the volume of $4.5 mln and over 4.8 mln roubles from the structures of Mechel – Yakutugol OJSC and Mechel-Mining OJSC.

The Court determined to collect $3.8 mln of debts for not making lease payments and the penalty of $712 thousand. The Court also collected 4.8 mln to cover the expenditure of the claimant for the purchase of foreign currency to buy the items of lease.

The Court rejected the counter-claim made by Yakutugol against Sberbank Leasing on the collection of 208.3 mln roubles of unreasonable earnings in the form of advance lease payments.

In June 2013 a redemption lease agreement was signed between Sberbank Leasing (lessor) and Yakutugol (lessee). The claimant purchased an excavator from the determined by the respondent seller and transferred it to Yakutugol. However, the respondent didn’t execute their obligations in a proper way, in connection with it the lease payment debt arose. Mechel-Mining is the guarantee by the agreement.
