Court has found 2.2 bln cubic m of free annual capacities at gas transport system of Sakhalin

The Arbitration Court of the Far East has found out the presence of free capacities at the gas transport system of Sakhalin at the volume of 2.2 bln cubic m a year in 2018-2028.

Rosneft requested the access for pumping of 8 bln cubic m a year in Court.

The Court of Appeal found out the presence of free capacities at the gas transport system of Sakhalin of the respondent at the volume of 1.9 bln cubic m in 2013 to 3.8 bln cubic m in 2010, in 2018-2028 – about 2.2 bln cubic m a year.

The Court decided to give Rosneft access to free capacities of 2.2 bln cubic m a year.

The Cassation Court thinks that the formulation of Rosneft’s claim doesn’t allow to say that the claimant asks to reserve the volume of free capacities of 8 bln cubic m a year. Based on the reading and explanation of the claim, Rosneft asks to provide it non-discriminatory access to free capacities.
