"Naftogaz" has challenged the transit contract with "Gazprom".

On the eve of the next round of gas talks the Ukraine is trying to raise the stakes, challenging the transit contract with "Gazprom" in the Stockholm arbitration court . Kiev intends to seek about $ 5 billion in compensation for the low volumes of transit in previous years, and most importantly - demands that the gas monopoly provides the technological support for transit. The latter condition may represent an immediate threat to Russian gas supplies into Europe.

"Naftogaz of Ukraine" has filed a second lawsuit to "Gazprom" in the Stockholm arbitration, this time challenging the transit contract concluded in 2009. Yuri Vitrenko, according to the head of the business reform department of "Naftogaz" claim was sent on Monday. The company asks to transfer the powers for transit contract to its subsidiary "Ukrtransgaz" and bring it in line with the EU Third Energy Package. Mr. Vitrenko stated that "Naftogaz" would insist on the principle of changing the tariff in accordance with the decision of the Ukrainian government N510 dated October 3rd, and also intends to demand compensation from "Gazprom" for too low transit volumes in previous years. "According to the contract, the minimum amount of transit is 110 billion cubic meters of gas per year, - Yuriy Vitrenko stated. – The calculation of loss covers the period from 2009 until the filing of the claim". "Gazprom" declined to comment.
