Rosneft gains 60 billion rubles from Russian Ministry of Energy

Rosneft has proved its right on return of 60 billion rubles of fees, overpaid at Verkhnechonskneftegaz, in another court. Cassation court supported the company. But the Ministry of Energy, which refused the company in this because of the statute of limitations, is not going to give up and will appeal to the Supreme Court. However, experts believe that the Government has little chance to challenge the decision of the court, and already since August there is no reason to not start paying the money.

The Russian Ministry of Energy and Rosnedra couldn’t appeal the decision of the Appeal Court in the Arbitration Court of the Moscow District concerning exemptions from export duties for Verkhnechonskneftegaz (belongs to Rosneft). Thus, the court upheld the right of the company on the refund of the tax overpayment of about 60 billion rubles. The Energy Ministry reported to the Kommersant that the Ministry would appeal the cassation decision in the Supreme Court of the Russian Federation. Also, the Cassation Court still considers a similar lawsuit of Verkhnechonskneftegaz to the Ministry of Energy and Rosnedra and a claim of Rosneft and RN Holding to the Ministry of Energy.
