Lukoil leaves energy market without capacity

Lukoil, stations of which didn’t pass competitive capacity outtake for 2015, has achieved its first success in the struggle for their return to the market. On the claim of the company, which demands to cancel the results of the procedure and to hold it again, the court entered interim measures until November. For a while, it doesn’t create critical problems for the industry, but if the suit consideration drags out, the conclusion of contracts for the sale of power by energy companies, which gives them up to 30% of the sale proceeds, will be complicated.

The Moscow Commercial Court has published a ruling on introduction of security measures for one of the two lawsuits of Lukoil’s structures (Lukoil-Volgogradenergo), challenging the results of the competitive capacity outtake for 2015. The company, which didn’t pass the procedure, demands to admit its results invalidate and to re-contest. Lukoil-Volgogradenergo applied for interim measures, since after fixing the results, conclusion of contracts between winners of the procedure and customers will begin, and, in fact, it will be impossible to fulfill the requirements of the company. As a result, the court prohibited System Operator of UES (manager of the energy system) to conduct actions, stipulated by the rules of competitive capacity outtake, using the results of the procedure, and commercial operator (Financial Settlement Center) – to conclude contracts for the sale of electricity. The next hearing on the lawsuit is scheduled for November the 11th.
